Welcome to Crown Vinyl, a curated online marketplace for rare and collectible records. By using the Service, you agree to these Terms and our Privacy Policy. Please read them carefully.

ACKNOWLEDGMENT AND ACCEPTANCE OF TERMS OF SERVICE

The functionality, features, and services available for use on the domain crownvinyl.co (including subdomains and related applications) (collectively, the "Service"), owned and operated by Blake Yoder (d/b/a Crown Vinyl) ("we," "our," or "us"), are provided to you ("you" or "your") under these Terms of Service (the "TOS") and any guidelines and policies we may publish. These Terms of Service form the entire agreement between you and us and replace any prior agreements on this subject. Additional policies and guidelines available on our Support & FAQs page supplement and are incorporated within this TOS. By using the Service, you agree to be bound by all terms and conditions in these Terms of Service, as well as any supplementary policies or guidelines we issue.

You must be at least 18 years old to use or access the Service in any manner, including registering for an account, unless your jurisdiction provides for a different minimum age to enter into a contract.

Please read these Terms of Service carefully. These terms include a mandatory arbitration provision and class action waiver within the "Dispute Resolution" section below. By agreeing to these Terms, you may be waiving certain rights, including the right to file a lawsuit in court, participate in a class action, or have disputes decided by a jury, as further described in our Privacy Policy.

We may update these Terms of Service at any time. If a change materially affects your rights, we'll make reasonable efforts to let you know—for example, by placing a notice on our site, sending an email, or using another reasonable method. We may not be able to provide advance notice when a change is required by law or when immediate action is needed to protect the Service or our users from security risks or fraud. We will not make changes that apply retroactively unless legally required or beneficial to you. If you do not agree to an update, you may stop using our Service or close your account.

By continuing to use our Service after any changes take effect, you accept the updated Terms. You should check this page periodically for the current version. Continued use of the Service means you acknowledge and agree to the updated TOS. We are not liable to you or any third party if we modify or discontinue the Service.

DESCRIPTION OF SERVICE

Crown Vinyl is a curated marketplace for record collectors and music lovers, where you can discover rare, important, and collectible vinyl records, learn about their history, and buy or sell with confidence. We provide content and communication tools that may include the ability to share information about records, communicate with other users, and manage listings through your account.

We may offer access to certain third-party content or services through the site. Your use of those third-party services is subject to their own terms and conditions, as described in the "Third-Party Terms" section below.

FEES AND PAYMENTS

Some portions of the Service are free to use, while others may require payment or meet certain conditions. Any applicable fees or requirements will be clearly explained and agreed to before you use those portions of the Service.

To buy or sell items through Crown Vinyl, you must create an account. If you sell records through our Service, you are responsible for any fees related to your sales. Current selling fees are listed on our Support & FAQs page. We may update our selling fees from time to time by posting notice on the site at least fourteen (14) days in advance, except for temporary promotions or reductions in fees, which may take effect immediately.

Crown Vinyl operates from the United States. You are responsible for providing your own internet connection and any related access costs.

All payments on Crown Vinyl are processed securely through Stripe, which also enables Apple Pay. When you buy or sell through the Service, funds are first collected by Crown Vinyl and then paid out to sellers through their connected Stripe account. We may make payments to you through Stripe Connect, and your acceptance of payments is subject to the Stripe Connected Account Agreement. By selling on Crown Vinyl, you authorize us to process payments and issue payouts on your behalf. All users are also subject to Stripe's Terms of Service and related policies.

Crown Vinyl is responsible for processing transactions and may be the initial recipient of chargeback notices or refund claims. However, sellers are financially responsible for chargebacks, refunds, and any other losses arising from their sales. Crown Vinyl may deduct or withhold amounts from a seller's future payouts to cover these obligations, in accordance with our Refunds and Returns Policy.

Any suspected fraudulent activity may result in immediate account suspension or termination and may be reported to the authorities. You are responsible for paying all applicable fees and taxes related to your use of the Service.

REFUNDS AND RETURNS

To ensure a consistent and fair experience for both buyers and sellers, Crown Vinyl maintains a single sitewide refund and return policy that all sellers agree to follow.

1. Eligibility

Refunds or returns may be approved only in the following cases:

  • The order is not shipped within seven (7) days of purchase.
  • The item arrives damaged.
  • The item is not as described in the listing.
  • The order is lost in transit and fails to arrive within the carrier's expected delivery window.

Refund requests must be submitted within seven (7) days of delivery (or within seven (7) days of the expected delivery date if the order never arrived).

2. How to Request a Refund

All refund or return requests must be initiated by contacting support@crownvinyl.co. Please include your order number and a clear description of the issue. If the item arrived damaged or not as described, attach photographs or other relevant evidence. Crown Vinyl will review the claim and may request additional information.

If the refund is approved, the buyer will be provided with instructions for returning the item to the seller. Damaged or misrepresented items must be returned to the seller in the same condition they were received. Sellers are responsible for providing a prepaid return shipping label in these cases.

3. Refund Method

Approved refunds are processed to the original payment method through Stripe once the return is confirmed delivered to the seller (if applicable) or when Crown Vinyl verifies that a refund is warranted (e.g., unshipped or lost orders).

4. Lost or Undelivered Orders

If an order is lost in transit, the buyer must notify Crown Vinyl within the carrier's claim period (currently 60 days for USPS, 60 days for UPS, and 90 days for FedEx). Sellers are responsible for filing carrier insurance claims.

5. Non-Refundable Situations

Refunds and returns are not permitted for:

  • Buyer's remorse or change of mind.
  • Minor cosmetic imperfections consistent with the item's described condition.
  • Delivery delays caused by the carrier once the seller has shipped the order on time.

6. Shipping and Pricing Responsibility

All prices on Crown Vinyl include shipping. Sellers are responsible for including the cost of shipping, packaging, and any desired carrier insurance in the listed price of each item, along with applicable fees and taxes. Sellers must ship using a trackable method and insure high-value orders appropriately.

USER ACCOUNT, PASSWORD, AND SECURITY

You must create a Crown Vinyl account to access certain parts of the Service, including buying or selling records. If you choose to sell through the Service, you may be asked to provide additional information for verification purposes. Crown Vinyl and its payment processor, Stripe, may collect and verify personal information as required by law. Failure to provide accurate or complete information may result in suspension or termination of your account until verification is complete.

We will use, process, and share your data for the purposes described in our Privacy Policy.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account, whether by you or by someone you authorize to use it. You agree to immediately notify us of any unauthorized use of your account or any other security issue by emailing support@crownvinyl.co.

You can manage your account information and preferences from within your account settings.

TERMINATION AND SUSPENSION

Either you or Crown Vinyl may end your use of the Service at any time.

1. Termination by Crown Vinyl

We may, at our discretion, suspend or terminate your account and remove your listings or content if:

  • you violate these Terms of Service, our Refunds and Returns Policy, or other site policies;
  • you provide false or incomplete information during registration or verification;
  • your activity poses a risk of fraud, chargebacks, or harm to other users; or
  • we are required to do so by law or by our payment processor.

If your account is terminated, we will notify you by email with the reason for our decision. In urgent cases—such as suspected fraud or safety risks—we may take action immediately and notify you afterward. Upon termination, your right to use the Service ends, and we may deactivate or delete your account and related information. We reserve the right to block future access to the Service. Crown Vinyl is not liable to you or any third party for any resulting loss of access, data, or content.

If your account is terminated while a payout or transaction is pending, Crown Vinyl may withhold funds until the related orders, disputes, or investigations are fully resolved.

2. Termination by You

If you wish to close your account, you may do so at any time through your account settings or by contacting support@crownvinyl.co. Closing your account ends your access to the Service, but any existing obligations—such as open orders, pending refunds, or fees owed—will remain in effect until completed.

3. Suspension

We may temporarily suspend your account or certain features while investigating potential violations or disputes. During suspension, you may still access your account to view information, but you may be unable to post listings, process orders, or withdraw funds until the issue is resolved.

LICENSE AND SITE ACCESS

Crown Vinyl grants you a limited, non-exclusive, and revocable license to access and make personal use of the Service. You may not download (other than for normal browser caching) or modify any part of the Service without our express written consent.

This license does not include:

  • any resale or commercial use of the Service or its content;
  • reuse of listings, descriptions, or prices outside Crown Vinyl;
  • downloading, copying, or redistributing account information for another merchant; or
  • the use of automated systems, bots, scrapers, or similar tools to collect data from the site.

You may not reproduce, duplicate, copy, sell, resell, or otherwise exploit any portion of the Service or its content for commercial purposes without our prior written permission.

Any unauthorized use terminates the permission or license granted by Crown Vinyl and may result in legal action, including claims for damages or injunctive relief.

USER CONDUCT

You are responsible for all activity that occurs under your account and for the content you submit through the Service, including listings, messages, and order details. Your use of Crown Vinyl must comply with all applicable U.S. laws and regulations.

By using the Service, you agree not to:

  • use Crown Vinyl for any unlawful purpose, including fraud, money laundering, or the sale of stolen or counterfeit goods;
  • harass, threaten, or abuse other users or engage in discriminatory or hateful behavior;
  • post or transmit content that is obscene, defamatory, or otherwise inappropriate for a public marketplace;
  • interfere with, disrupt, or attempt to gain unauthorized access to the Service or any related systems;
  • negotiate or complete sales outside the Crown Vinyl platform in order to avoid fees;
  • misrepresent items, falsify information, or list goods you do not own or cannot deliver;
  • create multiple accounts to evade restrictions or suspensions; or
  • upload, post, or send spam, junk mail, or unsolicited commercial messages.

We actively review reports of misuse and may investigate any activity that appears to violate these Terms. We may remove content, restrict access, suspend, or terminate accounts that violate our policies or pose risk to users or the platform. In serious cases—such as fraud or sale of stolen goods—we may immediately suspend your account and report the activity to law enforcement.

If we take action against your account, we will notify you by email and explain why. You can respond to clarify or appeal by contacting support@crownvinyl.co.

USER CONTENT

When you list an item or otherwise post images, text, or other material on Crown Vinyl (collectively, "User Content"), you retain ownership of that material but grant us the rights needed to operate the marketplace.

By submitting User Content, you represent and warrant that:

  • you own or have all necessary rights and permissions to post it;
  • your content does not infringe anyone's intellectual-property, privacy, or publicity rights; and
  • your use of the Service and your content comply with all applicable laws and these Terms.

You grant Crown Vinyl a non-exclusive, royalty-free, worldwide license to use, host, reproduce, display, and distribute your User Content solely for purposes of operating, promoting, and improving the Service. This license ends when your content is removed from the site, except where continued use is required for operational, legal, or archival reasons (for example, order records or backup systems).

Crown Vinyl does not endorse or guarantee any User Content posted by others and is not responsible for its accuracy or completeness. We reserve the right to remove, hide, or restrict access to any content that we believe violates these Terms, applicable law, or the rights of others, or that may otherwise be harmful to users or the Service.

If you encounter content that appears illegal or inappropriate, please report it to support@crownvinyl.co.

THIRD-PARTY TERMS

Crown Vinyl includes content created by users and may link to or integrate with services operated by third parties, such as Stripe for payment processing. These third parties have their own terms of service and privacy policies, which govern your use of their services.

You are responsible for reviewing and understanding any third-party terms that apply to your use of those services. Crown Vinyl does not control and is not responsible for the content, availability, or actions of any third-party site, app, or service.

By using Crown Vinyl, you acknowledge that we are not liable for any loss or damage arising from your dealings with third-party websites, services, or content, or from your reliance on information posted by other users.

PRIVACY POLICY

Your use of the Service is subject to our Privacy Policy, as applicable. Information about privacy and data protection can be found in this policy.

INDEMNITY

You agree to indemnify and hold harmless Crown Vinyl, its owner, affiliates, employees, contractors, and agents from any claims, damages, liabilities, losses, costs, or expenses (including reasonable attorney fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another person or entity. You are solely responsible for your conduct and for any obligations incurred through your account, including internet or access costs.

DISCLAIMER OF WARRANTIES

Your use of Crown Vinyl is at your own risk. The Service and all related content are provided "as is" and "as available", without any warranties of any kind, whether express or implied.

Crown Vinyl does not guarantee that:

  • the Service will be uninterrupted, secure, or error-free;
  • listings or information on the site will be accurate or reliable; or
  • any products purchased through the Service will meet your expectations.

No advice or information obtained from Crown Vinyl creates any warranty not expressly stated in these Terms.

LIMITATION OF LIABILITY

To the fullest extent permitted by law, Crown Vinyl and its owner, affiliates, and employees shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, including loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of (or inability to use) the Service.

In no event will Crown Vinyl's total liability to you for any claim related to the Service exceed the greater of (a) the amount you paid to Crown Vinyl in fees during the six (6) months prior to the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).

DISPUTE RESOLUTION AND ARBITRATION

Please read this section carefully—it affects your legal rights.

A. Agreement to Arbitrate

You and Crown Vinyl agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service will be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. This agreement to arbitrate is governed by the Federal Arbitration Act (FAA).

You and Crown Vinyl each waive the right to a trial by jury and agree to bring claims only on an individual basis, not as part of a class, consolidated, or representative action.

B. Procedure

Before starting arbitration, you must first send a written notice describing your dispute to Crown Vinyl, Attn: Legal/Arbitration, support@crownvinyl.co. Both parties will attempt in good faith to resolve the dispute within 60 days. If not resolved, the arbitration may proceed.

The arbitration will be conducted in New York County, New York, or by remote video conference if both parties agree. The arbitrator's decision will be final and binding, and judgment may be entered in any court with jurisdiction. Each party will bear its own costs, except that Crown Vinyl will pay any required arbitration filing or administrative fees.

C. Right to Opt Out

You may opt out of this arbitration agreement by sending written notice of your decision to support@crownvinyl.co within 60 days of first accepting these Terms. Opting out will not affect any other part of your agreement with Crown Vinyl.

D. Governing Law and Venue

These Terms are governed by and construed in accordance with the laws of the State of New York, excluding its conflict-of-law principles. If arbitration is not required, any legal action arising out of these Terms must be filed in state or federal courts located in New York County, New York, and both parties consent to that jurisdiction.

E. Severability

If any part of this section is found unenforceable, the remaining provisions will still apply, except that the waiver of class or representative actions may not be severed.

CONTENT MODERATION

Crown Vinyl reserves the right—but not the obligation—to monitor, review, or remove any content posted on the Service that we believe violates these Terms, applicable law, or the rights of others.

We may use a combination of manual review and automated tools to identify prohibited or potentially harmful content, but we do not pre-screen all listings or communications. Users are responsible for the content they post.

If you believe that content on Crown Vinyl is unlawful, fraudulent, or violates these Terms, please report it to support@crownvinyl.co. We review all valid reports promptly and may remove, restrict, or take other enforcement actions at our discretion.

We may also suspend or terminate accounts that repeatedly violate our policies or engage in harmful conduct, as described in the User Conduct and Termination sections.

VIOLATIONS

If you believe another user has violated these Terms or engaged in fraudulent or harmful behavior, please contact us at support@crownvinyl.co. Include as many details as possible—such as order numbers, usernames, or screenshots—so we can review the issue promptly.

To report alleged copyright infringement, please follow the instructions in our Intellectual Property and Copyright Policy above.

NOTICE

All official notices under these Terms must be in writing and may be sent by email to support@crownvinyl.co with subject ATTN: Legal.

We may send you notices by email, through your account dashboard, or by posting messages on the Service. Such communications are considered sufficient notice under these Terms.

ABOUT CROWN VINYL

The Service is owned and operated by Blake Yoder (d/b/a Crown Vinyl), based in the United States. Crown Vinyl is an independent online marketplace for collectible vinyl records and related media.

Until our formal business registration is complete, official correspondence may be sent electronically to support@crownvinyl.co. A physical mailing address will be added to this document once business registration is finalized.

GENERAL

These Terms are governed by and interpreted in accordance with the laws of the State of New York, United States, without regard to conflict-of-law principles. You and Crown Vinyl agree to submit to the exclusive jurisdiction of the courts located in New York County, New York, except where arbitration applies as described above.

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other. If any portion of these Terms is found unenforceable, the remaining provisions will continue in full effect.

These Terms constitute the entire agreement between you and Crown Vinyl regarding your use of the Service and supersede any prior agreements or communications.

These Terms have been prepared in the English language. In case of discrepancies between the English version and any translation, the English version shall prevail.
